Terms of Service

You retain ownership of content, prompts, files, brand information, links, and other materials that you upload or provide to LowKeyPost ("Input"). You give LowKeyPost a worldwide, non-exclusive, royalty-free permission to host, copy, store, process, transform, display, and transmit your Input only as reasonably necessary to provide, secure, maintain, and improve the service, comply with law, and prevent abuse.

You are responsible for ensuring that your Input is lawful and that you have all rights, permissions, and notices needed for LowKeyPost to process it and for you to download, share, or publish the result. This includes text, images, video, music, trademarks, personal information, and content belonging to another person or business. You are also responsible for the accuracy, quality, and legality of your Input and for how you obtained it.

You should keep independent copies of your Input, projects, and any Output you wish to retain. We do not guarantee that your Input, projects, or Output will always be preserved, recoverable, or available.

LowKeyPost may generate text, images, layouts, captions, advertisements, and other material based on your Input ("Output"). As between you and LowKeyPost, and to the maximum extent permitted by law, you retain all rights in your Input. To the extent that LowKeyPost has any right, title, or interest in Output generated specifically for you, LowKeyPost assigns to you all such transferable right, title, and interest that it may have.

This assignment does not apply to Output generated for other users, third-party content or assets, public-source material, stock or library media, datasets, third-party services, LowKeyPost's pre-existing materials, templates, software, models, model parameters, pre-trained weights, or improvements to the service. Output may be similar to output created for another user, may not be protected by copyright, and is not guaranteed to be original, accurate, lawful, or free of third-party rights.

LowKeyPost does not verify whether any Input, Output, content, or advertising you create using the service infringes third-party rights or complies with a platform's rules or policies. You are responsible for reviewing and clearing Output and ensuring that your use, publication, advertising, and distribution are lawful, accurate, and compliant before using them commercially or publishing them.

LowKeyPost may provide a library of trending posts and related publicly available discussions, videos, images, media, comments, links, metadata, trends, and other material from third-party websites and social platforms (the "Library of trending posts") for trend discovery, research, inspiration, content ideation, and marketing analysis. The Library of trending posts is provided for informational and discovery purposes only.

LowKeyPost does not claim ownership of material in the Library of trending posts and does not grant you a license to it. All rights in that material remain with the relevant creator, owner, or platform. LowKeyPost does not verify or guarantee the copyright status, licensing rights, accuracy, or completeness of such material, and does not guarantee that it is available for commercial use or has been obtained or displayed under a particular license. Your use of material from the Library of trending posts remains subject to applicable law and the terms, licences, and policies of the source platform. If you believe material in the Library of trending posts should be removed, contact us at align.dev.design@gmail.com with sufficient details to identify the material. We will review removal requests in good faith and may remove or disable access where appropriate.

LowKeyPost may provide access to stock images, library visuals, audio, video, fonts, templates, AI-generated media, or other creative materials through search, previews, templates, Image Bank, or generated results. LowKeyPost or Align Design may own the LowKeyPost software, interface design, branding, original text, and pre-existing templates. Other assets may be created by LowKeyPost, licensed from third parties, retrieved from public third-party websites or platforms, generated by AI, or otherwise made available through the service. Availability through the service does not mean that LowKeyPost owns an asset or that it is licensed for your use.

All third-party assets are provided strictly as-is, without warranties as to ownership, accuracy, licence, or right of use. Where you use third-party assets, you are responsible for ensuring that your use is lawful, appropriately licensed, and compliant with third-party terms, platform policies, attribution requirements, and applicable law. Before commercial use or publication, you should replace any asset with properly licensed material where necessary. By incorporating a third-party asset into published or distributed work, you assume responsibility for that use and the indemnity obligations in Section 10.

You may not redistribute, resell, licence, or otherwise make third-party assets available outside the service unless you have an independent right to do so. LowKeyPost may remove or replace an asset at any time without notice or liability. You are responsible for keeping local copies of projects that rely on these assets. We may process metadata, usage data, project data, and generated content associated with your use of these assets to provide, secure, maintain, and improve the service.

You may not use LowKeyPost to:

• Break the law, violate another person's rights, or infringe intellectual property.
• Use Source Content or third-party assets without the required permission or in breach of a source platform's rules.
• Upload malware, harmful code, or content intended to disrupt the service.
• Attempt to access another person's account or credentials.
• Use bots, scripts, crawlers, or other automated tools to access, query, test, or interact with LowKeyPost or its APIs without our written permission.
• Perform load testing, stress testing, benchmarking, send excessive requests, or otherwise interfere with the service.
• Copy, mirror, frame, reproduce, bulk-export, or systematically extract LowKeyPost's interface, database structure, design, code, or service materials, except for your own Input and permitted Output.
• Use prompt injection, adversarial instructions, or other methods to bypass safety systems, access controls, rate limits, or technical restrictions.
• Abuse, scrape, reverse engineer, overload, resell, share, or transfer access to LowKeyPost, or use it to build or assist a competing product or service.
• Upload sensitive personal information unless it is lawful, necessary, and you have the required rights and consents.
• Create or publish deceptive, fraudulent, hateful, or harmful content.

LowKeyPost may rely on third-party providers and platforms for hosting, storage, authentication, AI processing, source analysis, media delivery, and social-media integrations. Those providers and source platforms may have their own terms and policies. LowKeyPost does not control their availability, decisions, or content and is not liable for their suspension, restriction, termination, data loss, outage, moderation decision, or change in terms or functionality. Your use of them may be subject to their terms.

LowKeyPost and its software, interface, database structure, design, branding, text, code, templates, and underlying technology are owned by Align Design or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use LowKeyPost for your internal or business purposes. This license does not transfer ownership. You may not copy, reproduce, modify, mirror, frame, distribute, sell, sublicense, or use LowKeyPost or any part of it to create a competing product, except as expressly allowed by these Terms for your own Input and permitted Output.

You are solely responsible for all content generated, uploaded, published, distributed, marketed, licensed, sold, or otherwise used by you or anyone using your account through LowKeyPost. This includes Input, Output, Source Content, advertisements, and any AI-generated or synthetic media.

LowKeyPost does not verify, moderate, approve, endorse, or monitor the legality, accuracy, safety, or appropriateness of content generated or used through the service. You must ensure that your use of the service and all content complies with applicable laws, regulations, advertising standards, disclosure obligations, platform policies, intellectual-property rights, privacy rights, publicity rights, consumer-protection laws, and contractual obligations in each relevant jurisdiction.

You must not use LowKeyPost to impersonate a real person without lawful authority or consent, create deceptive or misleading synthetic media, or engage in fraud, harassment, misinformation, defamation, identity misuse, or other unlawful or harmful activity. You are responsible for obtaining all required consents, licences, permissions, releases, and authorisations relating to any likeness, image, voice, persona, trademark, copyrighted material, or personal information used with the service.

LowKeyPost makes no representation or warranty that generated content, Output, or suggestions are original, non-infringing, commercially safe, legally compliant, suitable for publication, accurate, or free from third-party claims. LowKeyPost is not responsible for how a third-party platform, regulator, authority, advertiser, customer, or other person interprets, restricts, flags, demonetises, removes, suspends, or otherwise acts in relation to content created through the service. You must conduct your own review, obtain necessary permissions or licences, and ensure that any final or published product complies with applicable law, platform policies, and advertising rules.

You represent that you have the rights and permissions required for your Input, your use of Output, and any content you download, share, or publish through LowKeyPost. To the maximum extent permitted by law, you agree to fully defend, indemnify, and hold harmless Align Design, LowKeyPost, and their officers, directors, employees, contractors, licensors, affiliates, agents, and service providers from and against any claims, demands, actions, liabilities, losses, damages, penalties, judgments, settlements, costs, and expenses, including legal fees where recoverable, arising out of or connected with: (a) your or anyone using your account's breach of these Terms; (b) your Input, content, or use of any Output or Source Content; (c) your breach of law or third-party rights, including intellectual-property, privacy, publicity, or moral rights; (d) your breach of any third-party platform terms; or (e) your creation, use, publication, distribution, licensing, sale, or commercialisation of AI-generated content or synthetic media. This indemnity does not apply to the extent that the loss was caused by our breach of these Terms.

We work to keep LowKeyPost available and reliable, but the service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, we disclaim warranties of uninterrupted operation, error-free or secure service, accuracy of generated or sourced content, ownership or license of third-party material, and acceptance of content by a third-party platform.

To the maximum extent permitted by law, LowKeyPost disclaims liability for any Output that: (a) infringes intellectual-property or other proprietary rights; (b) violates applicable law, regulation, or platform policy; or (c) causes reputational, commercial, or financial harm because you relied on or published it. You bear responsibility for the use, modification, publication, and distribution of Output created through the service. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

We do not guarantee the preservation, restoration, or availability of your Input, projects, account data, or Output. You are responsible for keeping independent copies of any data or Output you wish to retain. Before using, publishing, distributing, or commercialising any Output or synthetic media, you must conduct human review, verify rights in images, music, likenesses, trademarks, and personal information, and check applicable disclosure or labelling requirements. You must not use LowKeyPost to evade safety systems or platform restrictions.

LowKeyPost currently offers four plan tiers: Free, Starter, Creator, and Pro. Paid plans may be available on monthly or yearly billing cycles, as shown on the pricing page or checkout at the time of purchase. We may also offer token packs as one-time purchases. Plan features, limits, token allowances, prices, currencies, taxes, and eligibility are described in the applicable plan information and may change for future renewals or purchases.

Paid subscriptions automatically renew at the end of each subscription period unless you cancel before the next renewal. You authorize our payment provider to charge the applicable fees. If a payment fails, we may retry the payment, suspend or limit access, or change the account to an available free or restricted plan. Cancellation stops future renewals; unless applicable law or we expressly state otherwise, access and paid entitlements continue until the end of the current paid period.

Tokens are usage units for features within LowKeyPost. They are not money, a deposit, or property, and cannot be transferred, resold, or exchanged for cash. Tokens may be used only through the Services and do not create a cash refund right. Cancellation stops future subscription renewals and future included allowances, but does not automatically convert tokens already credited to your account into money. Unless the applicable plan or offer says otherwise, remaining tokens may be used while your account retains access to the relevant Services, and recurring allowances are not guaranteed to roll over to a future period.

Fees and token-pack purchases are non-refundable except where required by law or where we expressly provide otherwise. If a generation fails before a usable result is produced and our system records the run as failed, we may restore the tokens charged for that run. We do not guarantee a token restoration or cash refund for failures caused by your Input, your account, a third-party platform, or a third-party provider.
